1. Introduction

Welcome to Sleep Voyage.

These Terms & Conditions ("Terms") govern your use of the Sleep Voyage mobile application (the "App").

Sleep Voyage is operated by James Fogden, an individual developer based in Monaco ("we", "us", "our").

By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, you must not use the App.

2. Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data.

By using the App, you acknowledge that you have read and understood our Privacy Policy.

3. Description of Service

Sleep Voyage provides access to audio stories through a subscription-based model via Apple’s App Store.

Access to certain content requires an active paid subscription.

4. Eligibility

You must be at least 13 years old to use the App. If you are under 18, you must have permission from a parent or legal guardian.

5. Accounts

Access to the App requires signing in using Apple Sign-In.

Account sharing is not permitted. We reserve the right to suspend or terminate accounts that violate these Terms.

6. Subscriptions, Free Trials & Payments

Subscription Plans: We may offer Weekly, Monthly, and Yearly subscription options. Plans and pricing may change.

Billing: Payment will be charged to your Apple ID account at confirmation of purchase.

Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.

Apple will charge your Apple ID account for renewal within 24 hours prior to the end of the current period.

All billing is handled by Apple via the App Store.

Free Trial: If offered, it converts automatically into a paid subscription at the end of the trial period unless cancelled before trial end.

If applicable, any unused portion of a free trial is forfeited when a subscription is purchased.

Cancellation: You may cancel at any time via Apple ID settings. Cancellation takes effect at the end of the current billing period.

Refunds: Refund requests must be made directly to Apple and are subject to Apple’s refund policies. We do not provide refunds directly.

7. Intellectual Property

All content within the App is owned by or licensed to Sleep Voyage.

You may not copy, reproduce, distribute, resell, modify, or commercially exploit any content.

8. Acceptable Use

You agree not to misuse, reverse engineer, or interfere with the App or its subscription systems.

9. Service Availability

We aim to provide content that is of satisfactory quality, fit for purpose, and as described. However, we do not guarantee uninterrupted or error-free service.

Your statutory consumer rights remain unaffected.

10. Limitation of Liability

Nothing in these Terms excludes or limits liability where it cannot legally be excluded, including for death/personal injury caused by negligence, fraud, fraudulent misrepresentation, or breach of statutory rights.

To the maximum extent permitted by law, we are not liable for indirect or consequential losses, loss of profits, loss of data, or service interruptions beyond our reasonable control.

11. Communications

We may send service-related communications regarding your account or subscription.

We currently do not send marketing emails. If we introduce marketing communications in the future, we will do so in accordance with applicable law.

12. Governing Law

These Terms are governed by the laws of England and Wales.
